Warranty Information

Manufacturer warrants the products to conform to the specifications and drawings specified or furnished, and to be free from defect of material or workmanship for a period of 1 year from the date of shipment to the Buyer (the "Warranty Period"). Components and accessories not manufactured by seller, which are warranted separately by their respective manufacturers, are not warranted by the TailGate Ramp Manufacturer "Sherrer Contracting, Inc., and Manufacturer shall assign to Buyer whatever rights they obtain under such warranties. Manufacturer neither assumes nor authorizes any person to assume for it any other liability in connection with the sale or use of the products, goods, or services sold hereunder.

All warranties and any obligations of Manufacturer therewith shall automatically terminate with respect to any products or goods which are installed, used, or operated, are altered or repaired in any manner not authorized by Manufacturer, are otherwise misused, are damaged, or are not maintained in accordance with recommended practices and instructions. Sherrer Contracting, Inc. shall have no liability for any repairs made outside of Manufacturer's facilities unless made with the prior written consent. Manufacturer shall have no other obligations or liabilities of any kind. Retail Buyer assumes all risks and liabilities for any loss, damage or injury to persons or property resulting from Buyer's storage, handling, transportation, or use of products, materials, or goods whether used singly or in combination or otherwise.

THE FOREGOING WARRANTIES ARE IN LIEU OF, AND SELLER EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, BY OPERATION OF LAW OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SELLER SHALL HAVE NO LIABILITY TO BUYER FOR LOST PROFITS OR FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES OF ANY KIND.

IN NO EVENT SHALL SELLER BE LIABLE TO BUYER FOR ANY DAMAGES WHATSOEVER IN EXCESS OF THE PRICE OF THE PRODUCTS OR GOODS SOLD.
